These Terms explain the rules for using UCAPTM and how our reusable Universal ProfileTM, consent, verification and sharing services work.
1. Your agreement with UCAP™
These Terms of Use govern your access to UCAPTM and its consumer, client and staff services. By creating an account, signing in or using UCAPTM, you agree to these Terms. If you are acting for an organisation, you confirm that you have authority to bind it.
2. What UCAP™ provides
UCAPTM helps you build and manage a reusable Universal ProfileTM, store supporting documents, verify selected information and share information with recipients you choose. UCAPTM is not a lender, insurer, credit provider, financial adviser or legal adviser. A UCAPTM Pass or verification result describes the evidence available to UCAPTM; it does not guarantee that a third party will approve an application.
3. Your account and information
You must provide accurate information, keep it reasonably current and protect your password, passkeys and security factors. You are responsible for activity performed through your account unless you promptly tell us that it may have been compromised. You may not impersonate another person or upload information you have no right to use.
4. Sharing and consent
UCAPTM shares Universal ProfileTM information only when a valid consent or other lawful authority exists. Before sharing, review the recipient, purpose, information, documents, access mode and duration. Revoking live access prevents future access, but it cannot recall a frozen package or information a recipient lawfully received before revocation. Your disclosure history records material access and sharing events.
5. Documents, verification and third parties
You retain your rights in information and documents you upload. You give UCAPTM the limited permission needed to store, process, verify and disclose them according to your instructions and these Terms. Some services rely on providers such as identity, communications, hosting and payment providers. Their availability and processing may affect UCAPTM features.
6. Fees and paid services
UCAPTM will show applicable fees before you purchase a paid service. Provider fees, subscription terms, renewal arrangements and cancellation rights shown at checkout form part of these Terms. Operational messages needed for security or an existing service may still be sent where permitted.
7. Acceptable use
You may not use UCAPTM unlawfully; attempt to bypass security or consent controls; probe, disrupt or overload the service; introduce malicious code; scrape data without permission; or use another person's information beyond the scope they authorised.
8. Availability, suspension and closure
We work to keep UCAPTM available and secure, but uninterrupted operation is not guaranteed. We may limit or suspend access to protect users, investigate misuse, comply with law or perform maintenance. You may stop using UCAPTM and request account closure, subject to lawful retention and active consent or audit obligations.
9. Responsibility and liability
Each party remains responsible for loss caused by its fraud, wilful misconduct or breach of law. To the extent permitted by South African law, UCAPTM is not responsible for a third party's application decision, products, actions or use of information outside the consent granted to it. Nothing in these Terms removes rights that cannot lawfully be excluded.
10. Changes to these Terms
We may update these Terms as UCAPTM evolves or legal requirements change. The current version and effective date appear at the top of this page. We will give reasonable notice of material changes and may require explicit acceptance again where appropriate.
